Today, 8 May, the Verkhovna Rada of Ukraine will vote on the ratification of the so-called Agreement on Mineral Resources. As is well known, on 30 April, an agreement was signed between the Government of Ukraine and the Government of the United States of America on the establishment of the US-Ukraine Investment Fund for Reconstruction (hereinafter referred to as the Agreement or the Subsoil Agreement). American imperialism has exploited Ukraine's vulnerable position to impose a whole series of unfavourable conditions on it.
Despite the removal of some clearly oppressive conditions (such as ‘billing’ Ukraine for military aid already provided), it gives the United States new levers of influence over Ukraine's economic and political situation. At present, even its public defenders do not dare to say that it promises Ukraine prosperity or stability. The very question of when representatives of a foreign country will be able to determine the conditions for the exploitation of subsoil resources (which are the property of the Ukrainian people) on exclusive terms is outrageous. American capital and possibly part of the Ukrainian oligarchy will benefit from the agreement, but not the Ukrainian working people.
At the same time, it would be wrong to describe this agreement in terms of an irreversible national disaster. In the long term, Ukraine can free itself from colonial rule and try to denounce the Agreement if it gets rid of oligarchic capitalism and strengthens its sovereignty.
In the situation surrounding the Agreement, the following attracts the most attention:
The agreement is based on inequality between the parties. The parties agree to establish an American-Ukrainian Investment Fund for Reconstruction in the form of a limited partnership (hereinafter referred to as the Partnership). In essence, the contractual model provides significantly more advantages for the American side than for the Ukrainian side. The content of Article II of the Agreement on its primacy over Ukrainian legislation is indicative; the provision restricts the possibility of adopting acts that would mean less favourable conditions for the implementation of the Agreement. Article III, which refers to the need for institutional reforms consistent with ‘market principles,’ can be seen as veiled pressure to deepen neoliberal reforms. The Partnership's income will be exempt from taxes (Article IV), and companies will be able to withdraw capital from the country. Indemnity is mentioned only once, and only in the context of Ukraine's obligations (Article V). Any investment projects in the field of subsoil use or the operation of significant infrastructure facilities may be implemented after notifying the Partnership (Article VII). If Ukraine needs to take on certain additional obligations towards the EU, the parties to the Agreement must hold ‘good faith consultations and negotiations’ on how to take them into account (Articles VII, VIII).
The proposed model leads to retrograde simplification of the economy. The economic essence of the Agreement, among other things, is the joint activities of Ukraine and the United States in the search, exploration and extraction of natural resources, as well as the attraction of investment in critical sectors of the economy. Ukraine's main advantages in the eyes of American investors boil down to the extraction of natural resources. This will overshadow opportunities for mutually beneficial cooperation in infrastructure reconstruction or the development of knowledge-intensive technologies. Social issues (working conditions in the extractive sector, sustainable development) have been overlooked in the Agreement. Trade unions and environmental organisations did not participate in its discussion at all. Reconciling the interests of the extractive industry with public priorities could have positive consequences in terms of long-term interests.
Secret diplomacy undermines the legitimacy of the Agreement. The final terms of the agreement were kept secret until the last moment, which made public discussion on the matter impossible. The negotiations and preparations for them were held in secret, and the position of the Ukrainian government was unknown. The organisation of the voting process for the ratification of the agreement is also taking place in an atmosphere of opacity and within the shortest possible time frame. The Ukrainian public still does not have full information about the annexes to the agreement (the so-called Limited Partnership Agreement). The Main Scientific and Expert Directorate has not expressed its opinion on the draft law on ratification (No. 0309), as not all related documents were attached to the agreement.
The agreement does not strengthen security, but will limit sovereignty. During the war, Ukraine will not receive everything it needs from the United States, as is clear from Donald Trump's statements, but the signing of the agreement will reinforce the view that Ukraine will not be able to dispose of its existing wealth as before. The signing of the agreement is motivated by security considerations, but in reality it will not bring any benefits in this area. The promised military support is illusory (Article VI refers to the possibility of transferring weapons with their value subsequently being credited as a capital contribution by the United States). It is impossible not to notice how cautious the wording is regarding the Russian-Ukrainian war: Ukraine's contribution to maintaining international peace by countering Russian aggression is not even mentioned.
The signing of the Agreement is a consequence of the neoliberal government's inability to mobilise resources. It is precisely because of the fear of nationalisation of strategic industries, the introduction of a progressive tax scale and the fight against the shadow economy that Ukraine is forced to resort to risky ways of attracting investment. The signing of an agreement on future cooperation on unequal terms has become a necessity due to Ukraine's need to defend itself against Putin's invasion today. Ultimately, the signing of this agreement is a logical continuation of the Ukrainian government's proposal at the end of 2024 to develop mineral resources with foreign funds. The blackmail by the US administration already at the stage of preparing the agreement shows how difficult it will be to steer this process in the direction Ukraine needs.
The most important lessons to be learned from this situation are as follows: the history surrounding the agreement will objectively help dispel illusions about the nature of American imperialism, and the Ukrainian people will become even more convinced that they can only rely on themselves. The mineral resources available in Ukraine can benefit the people themselves, but for this to happen, the authorities must introduce a socialist model of economic management, in which the state controls the economy and distributes income among different social strata. In terms of international cooperation, there are opportunities to develop equal relations with European countries, which themselves are interested in seeing Ukraine strong and secure.

Mouvement social : l'accord sur les ressources minérales est-il bénéfique pour l'Ukraine ?
Aujourd'hui, 8 mai, la Verkhovna Rada (Parlement ukrainien) votera la ratification de l'accord dit « accord sur les ressources minérales ». Comme on le sait, le 30 avril, un accord a été signé entre le gouvernement ukrainien et le gouvernement des États-Unis d'Amérique sur la création d'un fonds d'investissement américano-ukrainien pour la reconstruction (ci-après dénommé « l'accord » ou « l'accord sur les ressources naturelles »). L'impérialisme américain a profité de la situation vulnérable de l'Ukraine pour lui imposer toute une série de conditions défavorables. Malgré la suppression de certaines conditions manifestement abusives (telles que la « facturation » à l'Ukraine de l'aide militaire déjà fournie), cet accord donne aux États-Unis de nouveaux leviers d'influence sur la situation économique et politique de l'Ukraine. À l'heure actuelle, même ses défenseurs publics n'osent pas dire qu'il promet à l'Ukraine prospérité ou stabilité. Le fait même que des représentants d'un pays étranger puissent, à des conditions exclusives, déterminer les conditions d'exploitation des ressources naturelles (propriété du peuple ukrainien) est scandaleux. Ce sont le capital américain et peut-être une partie de l'oligarchie ukrainienne qui profiteront de cet accord, mais pas le peuple ukrainien qui travaille.
Il serait toutefois erroné de qualifier cet accord de catastrophe nationale irréversible. À terme, l'Ukraine pourrait se libérer du joug colonial et tenter de dénoncer l'accord si elle se débarrasse du capitalisme oligarchique et renforce sa souveraineté.
Dans le contexte de l'accord, les éléments suivants retiennent particulièrement l'attention :
Il existe une inégalité fondamentale entre les parties. Les parties conviennent de créer un fonds d'investissement américano-ukrainien pour la reconstruction sous la forme d'un partenariat limité (ci-après dénommé « le Partenariat »). En substance, le modèle contractuel prévoit beaucoup plus d'avantages pour la partie américaine que pour la partie ukrainienne. L'article II de l'accord, qui porte sur sa primauté sur la législation ukrainienne, est révélateur : il limite la possibilité d'adopter des actes qui entraîneraient des conditions moins favorables à la mise en œuvre de l'accord. L'article III, qui évoque la nécessité de transformations institutionnelles conformes aux « principes du marché », peut être perçu comme une pression voilée en faveur de l'approfondissement des réformes néolibérales. Les revenus du Partenariat seront exonérés d'impôts (article IV) et les entreprises pourront transférer leurs capitaux hors du territoire national. La possibilité d'une indemnisation (indemnity) n'est mentionnée qu'une seule fois et uniquement dans le contexte des obligations de l'Ukraine (article V). Tout projet d'investissement dans le domaine de l'utilisation des ressources souterraines ou de l'exploitation d'infrastructures importantes peut être mis en œuvre après en avoir informé le Partenariat (article VII). Si l'Ukraine doit prendre certaines obligations supplémentaires envers l'UE, les parties à l'accord doivent mener « des consultations et des négociations de bonne foi » pour déterminer comment les prendre en compte (articles VII, VIII).
Le modèle proposé conduit à une primitivisation de l'économie. Sur le plan économique, l'accord porte notamment sur la coopération entre l'Ukraine et les États-Unis dans la recherche, l'exploration et l'extraction des ressources naturelles, ainsi que sur l'attraction d'investissements dans des secteurs critiques de l'économie. Aux yeux des investisseurs américains, les principaux atouts de l'Ukraine se résument à l'extraction des ressources naturelles. Cela relègue au second plan les possibilités de coopération mutuellement avantageuse pour la reconstruction des infrastructures ou le développement de technologies à forte intensité scientifique. Les questions sociales (conditions de travail dans le secteur extractif, développement durable) ont été ignorées par l'accord. En effet, les syndicats ou les organisations de protection de l'environnement n'ont pas du tout participé à sa discussion. La conciliation des intérêts du développement de l'industrie extractive avec les priorités sociales pourrait avoir des conséquences positives à long terme.
La diplomatie secrète sape la légitimité de l'accord. Les conditions définitives de l'accord ont été gardées secrètes jusqu'au dernier moment, ce qui a rendu impossible tout débat public à ce sujet. Les négociations et leur préparation se sont déroulées dans le secret, et la position du gouvernement ukrainien était inconnue. L'organisation du processus de vote pour la ratification de l'accord se déroule également dans un climat d'opacité et dans des délais extrêmement courts. La société civile ukrainienne ne dispose toujours pas de toutes les informations relatives aux annexes de l'accord (le « protocole sur le partenariat limité »). Le principal service scientifique et expert n'a pas évalué le projet de loi sur la ratification (n° 0309), car tous les documents connexes n'étaient pas joints à l'accord.
L'accord ne renforce pas la sécurité, mais limite la souveraineté. Pendant la guerre, l'Ukraine ne recevra pas tout ce dont elle a besoin des États-Unis, comme le montrent clairement les déclarations de Donald Trump, mais la signature de l'accord confirmera l'idée que l'Ukraine ne pourra plus disposer de ses richesses comme auparavant. La signature de l'accord est motivée par des considérations de sécurité, mais en réalité, elle n'apportera rien d'utile dans ce domaine. Le soutien militaire promis est illusoire (l'article VI mentionne la possibilité de transférer des armes, dont la valeur sera ensuite comptabilisée comme une contribution en capital des États-Unis). On ne peut manquer de remarquer la prudence des formulations concernant la guerre russo-ukrainienne : la contribution de l'Ukraine au maintien de la paix internationale par la lutte contre l'agression russe n'est même pas mentionnée.
La signature de l'accord est le résultat de l'incapacité du pouvoir néolibéral à mobiliser les ressources. C'est précisément par crainte de la nationalisation des industries stratégiques, de l'introduction d'une fiscalité progressive et de la lutte contre l'économie souterraine que l'Ukraine est contrainte de recourir à des moyens risqués pour attirer les investissements. La signature d'un accord de coopération future à des conditions inégales est devenue une nécessité absolue en raison du besoin de l'Ukraine de se défendre contre l'invasion de Poutine aujourd'hui. En fin de compte, la signature de cet accord est la suite logique de la proposition faite par les autorités ukrainiennes, dès la fin de l'année 2024, d'exploiter les ressources naturelles du pays avec des fonds étrangers. Le chantage exercé par l'administration américaine dès la phase de préparation de l'accord montre à quel point il sera difficile d'orienter ce processus dans la direction souhaitée par l'Ukraine.
Les principales leçons à tirer de cette situation sont les suivantes : l'histoire de cet accord contribuera objectivement à dissiper les illusions sur la nature de l'impérialisme américain, et le peuple ukrainien sera encore plus convaincu qu'il ne doit compter que sur lui-même. Les ressources minérales présentes en Ukraine peuvent profiter au peuple lui-même, mais pour cela, le pouvoir doit mettre en place un modèle économique socialiste dans lequel l'État contrôlera l'économie et répartira les revenus entre les différentes couches sociales. En matière de coopération internationale, il existe des chances de développer une interaction équitable avec les pays européens, qui ont eux-mêmes intérêt à voir l'Ukraine forte et protégée.
